Terms of

In brief

The website presents starting points, not an offer to sell online. Every project is defined in a written proposal or agreement before work begins.

2. Website information and enquiries

The website describes our work and provides indicative project starting points. It is not a binding offer, and sending a contact form does not create an agreement. We may accept, decline or propose a different scope for an enquiry.

We take reasonable care with the information on this site, but project suitability, availability and outcomes depend on the agreed scope and cannot be guaranteed by website information alone.

3. Quotes, scope and fees

A project starts only when its scope, deliverables, timing, fee, payment schedule and relevant assumptions have been confirmed in writing. The written proposal or project agreement takes precedence over these general website terms if there is a difference.

Unless expressly stated otherwise, prices shown on the website are in euros, are indicative starting points and exclude VAT. Additional work, changes in scope, third-party costs or new requirements are agreed separately before they are undertaken where reasonably possible.

4. Client materials and collaboration

You are responsible for ensuring that any copy, images, video, trademarks, product claims, data and other material supplied to us can lawfully be used for the agreed project. You remain responsible for timely approvals, accurate factual input and access to any services needed for the work.

Where a project needs specialist production, we may assign vetted independent specialists. KADER / CODE remains your principal point of coordination unless a project agreement says otherwise.

5. Rights in work

Each project agreement sets out the rights granted for final deliverables. Unless it says otherwise, all intellectual-property rights in concepts, working files, code, designs and other materials remain with Thomas Andp Photography until all due invoices for that work have been paid.

After payment, the client receives the rights or licence specifically agreed for the final deliverables. Pre-existing tools, reusable components, third-party materials and open-source software remain subject to their own applicable rights and licences.

6. Third-party services and availability

Websites rely on hosting, domains, email, analytics, browsers and other third-party services. Their availability, updates and terms are outside our control. We take reasonable care in selecting and configuring services, but cannot guarantee uninterrupted operation of third-party systems.

7. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded. To the extent permitted by law, our responsibility for a project is limited by the written agreement for that project. We are not responsible for indirect loss, loss of profit, loss of data or business interruption unless the law requires otherwise.

8. Privacy

Our handling of personal data is described in the Privacy notice.

9. Law and disputes

Dutch law applies, except where mandatory law gives a consumer a different protection. Before formal action, both parties will first try in good faith to resolve a concern directly.

10. Changes to these terms

We may update these terms for future website use or future enquiries. An accepted project remains governed by the version and documents agreed for that project.
